Suspension of projects implementation during the state of emergency

The Managing Authority for the Human Capital Operational Program (AM POCU) has published a set of additional clarifications regarding the application of the instructions no. 4/2020 and no. 5/2020, issued in March 2020.

According to the clarifications, the decision regarding the continuation or suspension of the implementation of the projects during the state of emergency belongs to the beneficiaries and is made at their initiative.

If the beneficiaries decide to suspend the projects, the procedure was simplified, being only necessary to submit a request to suspend the implementation of the project.

Moreover, AM POCU regulated the procedure for recovering the accumulated delays. Thus, the Managing Authority/Intermediate Body will allow, following the extension, the period of implementation of the project to exceed the maximum duration stipulated in the applicant’s guide. However, the value of the approved financing cannot be exceeded.

For projects that include entrepreneurship schemes, their managers can:

  • fully follow business plans;
  • suspend the implementation of businesses that are directly or indirectly affected by the spread of COVID-19 virus;
  • suspends the implementation of all business in the portfolio.

In the context created by COVID-19, the Managing Authority for the Human Capital Operational Program published on March 12 the measures that can support the implementation in good conditions of the funded projects.

The measures include:

  • the obligation of beneficiaries, partners and intermediary bodies to comply with the provisions of the National Committee for Special Emergency Situations, as well as those of all public authorities involved in managing the risk of spreading COVID-19 infection;
  • the permission to work remotely, if the infrastructure allows it;
  • distance communication between beneficiaries / partners and Intermediate Bodies;
  • procedure on how to recover delays in this period.
